Is Donald Trump trying to be held in contempt? His latest social media post seems to indicate he is determined to ignore the gag order U.S. District Judge Tanya Chutkan imposed on him by going to Truth Social and calling the judge “biased” and “Trump-Hating”.
U.S. District Judge Tanya Chutkan reinstated the limited gag order she imposed on Donald Trump while overseeing his federal election interference case.
However, despite the gag order, Trump took to Truth Social in what seems to be defiance of the gag order to rant against the order, the judge, and the case.
The Post
On October 30th, he posted:
“I have just learned that the very Biased, Trump Hating Judge in D.C., who should have RECUSED herself due to her blatant and open loathing of your favorite President, ME, has reimposed a GAG ORDER which will put me at a disadvantage against my prosecutorial and political opponents.”
It remains to be seen how the judge will respond to the post.
Unthinkable
Trump continued, “This order, according to many legal scholars, is unthinkable! It illegally and unconstitutionally takes away my First Amendment Right of Free Speech, in the middle of my campaign for President, where I am leading against BOTH Parties in the Polls. Few can believe this is happening, but I will appeal. How can they tell the leading candidate that he, and only he, is seriously restricted from campaigning in a free and open manner? It will not stand!”
It is worth noting that gag orders are legal, and the Supreme Court has previously ruled that gag orders are constitutional if they protect the right to a fair trial, are as least restrictive as possible, and will be effective (Yale Law School).
Witness Harassment
This is not the first time Trump has gone to Truth Social to rant against his numerous court proceedings.
In a filing to U.S. District Court Judge Tanya Chutkan overseeing Trump’s federal election interference case in Washington, Smith’s team denounced Trump’s posts on Truth Social as “harmful.” They contended that Trump’s message, labeling certain individuals as “weaklings and cowards” and as a detriment to the nation’s future, was a deliberate attempt to convey a threatening message to a potential witness in the case.
